1. Terms of sale

1.1 Purpose

These terms govern the sale of licenses to use the FloorDesk One software (the "Software"), published by Jean-Emile Gilbert EI (ASHIYR AGENCY) (the "Publisher"). Placing an order means accepting these terms.

1.2 Reseller

Orders are processed by Lemon Squeezy, LLC, acting as official reseller ("Merchant of Record"): Lemon Squeezy collects the payment, issues the invoice, and collects and remits the VAT or sales tax applicable in the buyer's country. Lemon Squeezy's buyer terms (lemonsqueezy.com/buyer-terms) apply to the payment. The Publisher remains responsible for the Software and for support.

1.3 The Software and the license

The Software is trading practice software (charts, market replay, economic news calendar, simulated order management, journal and performance analysis) running on Windows 10 and 11 (64-bit). All orders in it are simulated: the Software does not connect to any brokerage account and places no real orders. It does not provide market data: users use their own data (broker history, CSV files), free public sources or their own subscriptions. ASHIYR AGENCY is not an investment services provider and never holds funds. The license is personal, non-exclusive and non-transferable; it allows use of the Software on one computer at a time. Copying, reselling, decompiling or circumventing the protection is prohibited.

1.4 Plans and prices

Prices include VAT for buyers in the European Union and may vary with the buyer's local taxes, calculated at checkout. A 7-day free trial, with no payment method required, lets you test every feature before buying.

1.5 Delivery

The Software is downloaded from this website. The license key is emailed immediately after payment. Activation requires an internet connection; the license is then checked once a week, with 14 days allowed offline.

1.6 Subscriptions and cancellation

Subscriptions have no minimum term. The buyer can cancel at any time from the link in the purchase email or by writing to us; cancellation takes effect at the end of the period already paid, at no cost. When the subscription ends, the license stops working; the user's data (journals, screenshots, settings) stays on their computer.

1.7 Right of withdrawal and refunds

The Software is digital content supplied immediately after payment. By placing an order, the buyer expressly requests immediate access and acknowledges losing the right of withdrawal, as provided by EU consumer law. Amounts paid are not refunded, including for a subscription period already started, unless required by law. The 7-day free trial, with no payment method, lets you test every feature before buying, and the subscription can be cancelled at any time for the following periods (article 1.6).

1.8 Liability and risk warning

Trading financial markets carries a high risk of losing money. The Software is a trading analysis, practice and management tool: it is not investment advice, provides no trading signals and guarantees no results, including passing an evaluation with a proprietary trading firm ("prop firm"). Simulated or past results are not indicative of future results. The prop firm rules offered in the Software are indicative templates, to be checked with each firm. Apex, Topstep and FTMO are trademarks of their respective owners, not affiliated with the Publisher. The Publisher's liability is limited to the amount paid for the license over the last 12 months.

1.10 Governing law and disputes

These terms are governed by French law. Consumers may use the consumer mediator free of charge: being appointed. Mandatory consumer protection rules of the buyer's country of residence remain applicable.

This website sets no cookies, uses no analytics and loads no third-party resources. It is hosted by GitHub Pages (GitHub, Inc.), which may log visitors' IP addresses for security purposes, under its own privacy policy.

2.3 Purchase and support

When you buy, your name, email, billing address and payment details are collected and processed by Lemon Squeezy, the official reseller, under its privacy policy (lemonsqueezy.com/privacy). The Publisher receives your name, email and order details to manage your license and support. This data is kept for the duration of the business relationship and then as long as legally required. It is never sold.

Free trial: to download the trial, you give your name and email (collected by Lemon Squeezy, as for a purchase). The Publisher uses them to send you the download link and, only if you agreed, news about FloorDesk One. You can unsubscribe at any time with the link in every email or by writing to contact@floordeskone.com. This data is kept for at most 3 years after your last contact.

2.4 Your rights

You have the right to access, rectify, erase, object to, restrict and port your data by writing to contact@floordeskone.com. You may also lodge a complaint with your data protection authority (in France: CNIL).
